The United States provides a variety of relief options for illegal immigrants who are seeking U.S. citizenship. Some of these relief options apply to immigrants who originally came to the United States as minors and want to continue to live in the U.S. legally. However, the process of achieving legal status through one of these methods on your own can be very difficult, which is why it is always recommended to get the assistance of an immigration attorney.
Jonathan Berdugo is dedicated to personally assisting immigrants through the complex legal process of achieving legal status. He will help you understand what your options are and ensure you follow the correct legal steps so you don’t experience any delays or the risk of removal.
DACA Definition
One of the options available to immigrants who came to the United States as children is a DACA, or a Deferred Action For Childhood Arrivals. This is an administrative relief option that protects undocumented immigrants from the risk of being removed or deported from the U.S. It also supplies them with a work permit so that they can continue to reside and support themselves in the United States.
Something to keep in mind about DACA is that it is not part of the process of becoming a U.S. citizen. Immigrants who want to become U.S. citizens will have to use other methods, especially since DACA is only applicable for two years before it has to be renewed.
DACA Requirements
For immigrants to be eligible for a DACA, they must have come to the U.S. before turning 16 and before June 15, 2007. They must also be under the age of 31 as of June 15, 2012. Other requirements include being enrolled in school, having completed high school, or being a veteran.
Because of the requirements of a DACA and its short lifespan, it is most often used by students who want to continue their education in the United States. They may choose to move back to their country of origin after they have completed their education or they may start the process of becoming a United States citizen.
Knowing whether or not you qualify for DACA can be difficult due to the different requirements and the fact that it can change every year. Because of this, it is a good idea to hire a DACA lawyer to help you navigate this process and avoid deportation.
DACA Renewal Process
The process of renewing your DACA is quite extensive, and it is highly recommended that you begin this process six months before your DACA expires. You should also seriously consider hiring an immigration attorney who has experience in the DACA process and can help you avoid common issues that could delay your renewal.
You will need to fill out and submit forms I-821D, I-765, and I-765WS, as well as include a copy of your employment authorization document. When you submit this information, make sure you include two passport-size photos and the application fees. Once you do this, you will receive a receipt in the mail that includes the information you need for your biometrics appointment and to get your fingerprints taken.
After being fingerprinted, you will receive a request for evidence or a final decision regarding your renewal. If it is a request for evidence, you may need to submit additional information before the renewal is complete. On average, DACA renewals take 3 to 3 1/2 months to be approved, which is why it is crucial that you submit your renewal application correctly to avoid any delays.
Getting DACA Advance Parole
Depending on your circumstances, you may need to consider getting a DACA advance parole instead of an average DACA. A DACA advance parole allows you to travel abroad and receive advance authorization to re-enter the U.S. This is usually only granted to individuals who are traveling for educational, employment, or humanitarian purposes.
The process of getting approved for a DACA advance parole takes at least 13 to 16 months, and you will need to provide extensive evidence and information that the USCIS requires. A DACA attorney can help you navigate this process and provide the information required so that you get approved as soon as possible.
